Section 1 : RULES FOR THE USE OF THE PLATFORM

Preamble

Bitpost is a platform that offers a matching service between supply and demand in order to complete the purchase of items through peer to peer payment between users by means of bitcoin.

  1. Registration with Bitpost.

Currently, users may make use of the service offered by registering solely by means of email, without the need to provide any further data for the purpose of registration.

In a subsequent implementation, users will be able to register in a privacy oriented mode using login through the third-party platform NOSTR, using the public key of the NOSTR account.

The platform in its current version associates accounts solely with the email address used for registration.

  1. How purchases work ON THE BITPOST PLATFORM.

2.1) Bitpost supports two types of purchase requests: through VERIFIED PLATFORMS or through NON-VERIFIED platforms.

2.2) Purchase request with LINK through platforms verified by Bitpost via API.

The user registered with Bitpost takes on the role of BUYER.

They may formulate their own purchase request by pasting on the platform the link containing all the characteristics of the desired item, choosing the desired quantity in the dedicated section of the purchase requests

2.3) Shipping charges The shipping of the selected items is not included in the price shown on the platform, since the platform extracts through the API only the price of the item net of shipping costs.

The price of the item is extracted with the API and shall unavoidably be borne by the party who carries out the purchase operation, called the "BITWORKER".

In order to complete the purchase, the Buyer shall in any event always bear the shipping and/or transport costs, paying such amounts to the Bitworker, as well as paying Bitpost the commissions for the use of the platform.

Each link corresponding to each individual new product shall always be entered in a new purchase request.

In the event that multiple items are selected in a single link, the request shall not be deemed valid and shall therefore be discarded by the platform.

2.4) The order book Once uploaded by the requesting Buyer, Bitpost shall proceed to enter the request into an order book, visible to all registered users. The order book shall constitute the actual peer to peer marketplace between users.

Bitworker users will view such requests and may take them on, satisfying the Buyer's purchase request by buying the item on their behalf, which will always be shipped by the Bitworker to the place indicated by the Buyer. The consideration for the service performed by the Bitworker, once the exchange is completed, shall be paid to them through the Bitcoin deposited in a multi-signature wallet.

The multi-signature Wallet can be managed and the funds contained therein can be unlocked only if both parties confirm the successful outcome of the exchange.

2.5) Example of EXCHANGE FLOW BETWEEN THE PARTIES:

  1. Creation of a purchase request promoted on the platform by the BUYER

  2. Pick-up by an interested BITWORKER of the order from the order book.

  3. Deposit of funds by the BUYER into the multi-signature wallet equal to the value of the item plus the fees selected and chosen from -5% to +8 by the BUYER.

  4. Purchase of the item by the BITWORKER, shipped directly from the ecommerce to the address/locker chosen by the user.

  5. Provision of the pick-up codes to the BUYER or PROOF OF DELIVERY at the address.

  6. Release of the funds in favor of the BITWORKER by the BUYER as soon as the latter has received the item.

IMPORTANT DISCLAIMER ON SHIPPING:

Bitpost is not responsible for theft, loss or damage of the item, since it does not provide a delivery service, delegating to the BITWORKER the management of such service, in fact relying on third-party couriers chosen and managed directly by the e-commerce sites, which in turn are chosen by the Buyers themselves.

The service may provide possible assistance through the verification of the signatures of the original emails received from the Bitworkers and in order to provide useful elements for the assessment of the non-receipt of the item in the event of delays, thefts, losses.

  1. Purchase request with LINK to platforms NOT verified by Bitpost via API.

The user registered with Bitpost, taking on the role of BUYER, may formulate their own purchase request by entering the link in the dedicated section relating to the purchase requests of the platform, containing within it all the characteristics of the desired item and the desired quantity.

Each link of each individual product shall always be entered in a new purchase request.

Should multiple items be selected in a single link, the request shall not be deemed valid and shall therefore be discarded.

Once the request is uploaded, Bitpost shall proceed, in this case as well, to enter it into the order book, visible to all registered users, creating an actual peer to peer marketplace between users.

Bitworker users will view such requests and may take them on, satisfying the Buyer's purchase request by buying the item on their behalf, which will always be shipped by the Bitworker to the place indicated by the Buyer.

The consideration for the service performed by the Bitworker, once the exchange is completed, shall be paid to them through the Bitcoin deposited in a multi-signature wallet.

The multi-signature Wallet can be managed and the funds contained therein can be unlocked only if both parties confirm the successful outcome of the exchange.

IMPORTANT DISCLAIMER

All platforms that are NOT verified and not connected to Bitpost place upon the BUYER the burden of manually entering the price of the items and the related shipping cost required, effectively obliging the user to make sure, including through a preliminary purchase simulation, that they create a correct and complete purchase request, so that it can be entered into the orderbook in favour of the bitworkers who will subsequently carry out the order to purchase the item.

This function grants users complete freedom to use any ecommerce. That same opportunity requires the Bitworker to manually verify the price of the item at the time of purchase in order to prevent any attempts at fraud.

Should the parties become aware of an attempted fraud, they may report the occurrence to bitpost, which will ascertain the attempted fraud by punishing the account in question with measures that may lead, in the most serious cases, even to the exclusion of the e-commerce from the platform.

3.1)MAIN FLOW OF EXCHANGE BETWEEN THE PARTIES:

  1. Creation of the purchase request promoted on the platform by the BUYER

2) MANUAL ENTRY OF THE ITEM PRICE AND SHIPPING.

  1. Withdrawal of the order from the orderbook by an interested BITWORKER.

  2. Deposit of the funds by the BUYER into the multi-signature wallet equal to the value of the item plus the fees selected and chosen from -5% to +8 by the BUYER.

  3. Purchase of the item by the BITWORKER, shipped directly from the ecommerce to the home address/locker chosen by the user if the e-commerce allows it

  4. Provision of the pickup codes to the BUYER or PROOF OF DELIVERY if shipped to the home address.

  5. Release of the funds in favour of the BITWORKER by the BUYER as soon as the latter has received the item.

  6. Shipment of items, order number and tracking Bitpost reserves the right to share the addresses entered autonomously by users in their own profile with the counterparties involved in the purchase. The exchange will take place exclusively at the moment the match has occurred.

4.1) Order number For each purchase made by the Bitworker, Bitpost will also require the entry of the order number issued by the e-commerce queried.

This procedure will allow the platform, in the event of a dispute, to verify, through the email received by the bitworker and subsequently forwarded to Bitpost, the correspondence between the email, the order number and the item ordered.

Subsequently, based on the verification, the platform will determine in favour of which user the issue affecting the ordered object is to be resolved.

4.2) Tracking Tracking is optional since not all e-commerce sites provide such information, both verified and non-verified platforms.

The BITWORKER may optionally enter it later when the e-commerce or the item in question allows it, earning reputation points for each optional piece of information.

5) SERVICE COSTS

Bitpost applies to each exchange a commission on the transaction equal to 8%, split between the parties or paid solely by a single user based on the prior agreements the parties see fit to establish before the purchase.

The amounts will be withdrawn by the platform at the time of the deposits made by the buyers and the withdrawals made by the bitworkers.

Bitworkers may offer up to a 10% discount for Buyers, and the Buyers themselves may request up to a 10% discount for their requests.

6) PAYMENT METHODS

Bitpost does not receive payments directly from the platform's users. The funds relating to the transaction commissions are deposited by the users into the multi-signature wallet, to which Bitpost does not have autonomous access. Upon the outcome of the completed transaction between the parties, Bitpost will have the right to withdraw the amount relating to the commission with the agreement of the parties.

SEZIONE 2: TERMS AND CONDITIONS OF USE OF THE SERVICE

Terms and Conditions of Bitpost

  1. Introduction Bitpost is a website open to all users aged 18 or over.

By registering, users declare by tacit consent that they are of legal age, releasing Bitpost from all liability.

1.1) Bitpost (www.bitpost.shop) offers a peer to peer matching platform that allows the meeting of the demand to purchase items coming from any e-commerce in exchange for the offer of payment in Bitcoin and vice versa.

Before reading and signing this document called "terms & conditions", the user declares that they have read and expressly accepted the regulations governing the use of the platform in every part thereof. Should the user not agree with one or more parts of it, they are asked not to proceed with any operation to register on the platform.

  1. Definitions "Bitpost", "we", "our" refer to the Bitpost platform.

"User", "you", "your" refer to the user who uses the Bitpost services.

  1. Registration and Account

3.1 To use Bitpost, the user must register by providing their e-mail.

3.2 The latter is responsible for the security of their account and for the activities carried out on the basis of the references provided to the platform and to third parties.

3.3 The user also undertakes to use the Site only for lawful purposes and in such a way as not to infringe the rights of third parties or restrict or prevent the use and enjoyment of the Site by third parties. Conduct that may damage, disable, overload or impair the Site is prohibited.

IMPORTANT DISCLAIMER:

PURCHASE REQUESTS ARE NOT PERMITTED FOR ALCOHOL, WEAPONS,

DRUGS AND ITEMS THAT BY THEIR NATURE CONSTITUTE

THE OBJECT OF A CRIME OR UNLAWFUL ACTS IN GENERAL.

3.4 Bitpost reserves the right to suspend or terminate accounts that violate these terms or display characteristics attributable to unlawful activities or presumed as such.

  1. Privacy and Personal Data

4.1 Bitpost is designed to optimize user privacy in peer-to-peer purchases. To access certain features of the Site, the user may be required to create an account. The user is responsible for maintaining the confidentiality of their credentials, the private key of their account, and all activities that occur under their account.

The user undertakes to notify Bitpost immediately of any unauthorized use of their account.

Bitpost collects and retains only the information strictly necessary to provide the service and for as long as is needed to maintain the account.

4.2 Bitpost does not associate the customer's first name/last name directly with identifying personal data.

4.3 Order information is encrypted and accessible only for processing the requests initiated by the user.

4.4 Bitpost does not share, sell, or rent the collected data to third parties without the user's express consent.

  1. Purchasing Service

5.1 Bitpost provides a peer-to-peer platform that can be used by customers as a matching tool for purchases between users on third-party platforms.

5.2 By registering on the platform, the user accepts and authorizes Bitpost to conventionally exercise the function of arbitrator in the event of a dispute between users, using, if necessary, the information provided by the customers.

5.3 The customer is nonetheless responsible for the accuracy of the information provided for the purchases.

  1. Payments and Fees

6.1 Bitpost offers payment options in Bitcoin.

6.2 The fees for the purchase-matching service are expressly chosen and communicated to the platform by the users, and are apportioned and attributed conventionally among themselves or even to only one of the parties.

6.3 The user who registers for the Bitpost service agrees to pay both the price of the item and the fees due to Bitpost at the time the order is concluded.

6.4 All sums received and intended for the purchase and payment of the fees are deposited in a multi-signature wallet created specifically by third parties for the two counterparties at the time of connection for the exchange.

6.5 From the aforementioned specific Wallet, the fees due to Bitpost from both parties are apportioned and sent.

6.6 The use of the multisig wallet provided by third parties guarantees the platform's impartiality with respect to the fund transactions and ensures a high level of security for the customers.

6.7 The user accepts that Bitpost will always withhold from each multi-signature wallet, created by third parties specifically for each pair of users, only the fee owed to it, equal to 8%, while nonetheless leaving to the pair of users, as parties to the transaction, the determination of the apportionment between them of the aforementioned commission fee.

  1. Shipping

7.1 Bitpost is not responsible for shipments.

Deliveries of the goods subject to the transaction and coming from e-commerce platforms external to the Bitpost platform take place through couriers or lockers made available by the e-commerce platforms. Bitpost has no interaction with the e-commerce platforms regarding the use of the couriers they offer.

7.2 The user is responsible for providing accurate information for shipping.

7.3 Bitpost is never responsible for delays or delivery problems caused by carriers that are third parties to it, or for other circumstances outside the matching activity offered by the platform.

  1. Liability

8.1 Bitpost is likewise not responsible for the quality or suitability of the products purchased through its service. Bitpost will also not be liable for damages of any kind arising from improper use of the Site, including, but not limited to, direct, indirect, incidental, punitive, and consequential damages.

8.2 Bitpost's liability is ultimately limited to the value of the service provided.

8.3 The Site www.bitpost.shop may contain links to third-party websites that are not owned or controlled by Bitpost. Bitpost has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party website. The user acknowledges and agrees that Bitpost shall not be liable, directly or indirectly, for any damage or loss caused or allegedly caused by or in connection with the use of or reliance on such content, goods, or services available on or through such websites.

8.4 Customs duties. In the event that the purchase of the requested item is subject to the application of customs duties, it is understood that the amount of such duties will be borne by the Buyer, who, when placing the order, must calculate the additional cost of the aforementioned duties and pay them together with the price of the item to the Bitworker.

  1. Cancellations and Refunds

9.1 In the event that the user intends to cancel their request or offer within the platform, the platform, upon the user's express request, will make the operation possible solely and exclusively before the order has been fulfilled (picked up by the BITWORKER and subsequently paid for by the BUYER).

Any refund requests arising from unverified platforms are not accepted by Bitpost, since the service offered by Bitpost is a mere p2p connector between supply and demand, which excludes any further operability in conjunction with the use of unverified e-commerce platforms.

Bitpost is able to guarantee refunds and returns exclusively arising from the use of the Amazon e-commerce platform if the "gift" option is used, as well as by being in possession of the number of the order placed, thereby allowing the recipient to exercise their right to a refund on the received item if contemplated by the e-commerce platform.

9.2 Third-party sellers on the Amazon platform Amazon, within its own marketplace, allows the sale of goods directly by third parties. Should the Buyer purchase items from certain parties external to Amazon, even if hosted within its marketplace, Bitpost will not be able to guarantee refunds and returns according to the policy offered by Amazon.

On the contrary, all parties accept the circumstance that the refund and return policy promoted by the third-party seller will be applicable.

  1. Amendments to the Terms

10.1 Bitpost reserves the right to amend these terms and conditions at any time.

10.2 Material amendments will be notified to users at the contact details provided by the customer upon registration and will in any case be notified via e-mail. The user's use of the Site and of the service offered by the platform after the publication of the amendments implies acceptance thereof.

SECTION 3: NOTICE FOR THE SPECIFIC EXCLUSION OF WARRANTIES

AND LIABILITY By using the Bitpost website (www.bitpost.it), the user accepts this disclaimer of liability. In the event of express non-acceptance of the terms and conditions of service of the Bitpost platform, and the conditions of this notice, the user is requested not to use the Site and the services connected to it.

  1. Content of the Site The Site and its contents are provided "as is" and "as available".

Bitpost does not guarantee the accuracy, completeness or currency of the information present on the Site. The use of the information or materials present on the Site is at the user's sole risk.

  1. Exclusion of Warranties To the maximum extent permitted by applicable law, Bitpost excludes all warranties, express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose and non-infringement. Bitpost does not guarantee the continuity of its service through the site, or that the same is free from errors or that any defects will be immediately corrected.

2.1 Exclusion of Warranties on the purchase of Items Bitpost is relieved of any liability regarding the incorrect communication of the purchase requests communicated by customers.

Within the purchase request, every characteristic of the item commissioned for purchase must be specified; should the request made by the user not be correctly fulfilled, the latter has the possibility of requesting the return to Bitpost through the conditions defined by the terms of law and bearing the expenses necessary to cover the shipping costs.

2.3 Liability for purchases by Bitpost Bitpost has the right to assess the users' purchase requests on the basis of the type of item chosen and requested by the Buyer.

Should illegal purchase requests be initiated, Bitpost will automatically delete the user's account without any form of communication.

Bitpost has no liability for errors committed by either party during the exchange. Bitpost's responsibility is to provide the service that allows the parties to interconnect and to be able to exchange an item on account of payment in Bitcoin as well as, in the event of a dispute between users, to verify via e-mail the truthfulness of the information provided.

No return, for any reason or on any grounds, may be charged to Bitpost nor may it be requested of it.

2.4 Exclusion of Warranties on the Shipping of Items Bitpost is a priori relieved of any and all liability regarding items lost, damaged, stolen, shipped directly from the websites provided via links by the users to Bitpost.

The user accepts that it is incumbent upon the e-commerce platform receiving the product order and from which the item was purchased to indicate the eligibility for return to the Bitworker who submits a return request for platforms not verified by Bitpost. This eventuality is excluded in the case of purchases made through the gift option on the Amazon e-commerce platform, a platform that can autonomously enable the Buyer to make the return request, without requiring any action by the Bitworker.

Bitpost cannot be held liable in the event that the return is not executable for reasons intrinsic to the purchase platform or by the will of the Bitworker, Bitpost being, as previously specified, an exclusively peer-to-peer matching platform.

  1. Limitation of Liability

3.1 Direct and Indirect Damages In no event shall Bitpost, its employees, directors, agents, partners or suppliers be liable for direct, indirect, incidental, special, consequential or punitive damages, including, but not limited to, loss of profits, data, use, goodwill or other intangible losses, arising from or in any way connected to the use of or inability to use the Site.

3.2 Total Liability Bitpost's total liability towards the user for any claim arising from or related to the Site is conventionally limited to the amount paid by the user for the use of the Site in the 12 months preceding the date of the claim.

SECTION 4: TERMS AND CONDITIONS OF RETURN, REFUND

  1. Introduction Thank you for purchasing through Bitpost.

Should the user not be completely satisfied with their purchase, Bitpost is available to take action to improve its relationship with the user. These Return Terms and Conditions describe the return and refund policies of the website www.bitpost.shop as a platform for matching and peer-to-peer exchange between users. The user is informed that the likelihood of returns relating to purchases on the various e-commerce platforms is limited and delegated to the activities of the parties.

  1. Return period The BUYER user may request the appointed Bitworker to return an item within 14 days from the date of receipt. To be eligible to request a return, the item must be unused and in the same condition in which it was received.

It must also be returned in its original packaging.

It is understood that the BITWORKER, having purchased the item through a peer-to-peer service, has no obligation whatsoever to accept a return, but it remains entirely within their discretion to consider the return as an option should they voluntarily accept the request.

Buyers who intend to request a return from the BITWORKER will have available on the platform a "return request" section active for the entire duration relating to the return terms and conditions.

  1. General Return Conditions

3.1) Return Options There are two return options, and they are operable solely and exclusively upon an explicit request submitted by the Buyer to the Bitworker.

It will be the sole responsibility of the destination e-commerce platform for the order, through which the item was purchased, to issue the return approval in favour of the Bitworker, following the Buyer's request.

Bitpost reminds that, by using a peer-to-peer service, there is no obligation for Bitworkers to carry out returns, except in the case where objective errors attributable to the Bitworker themselves can be identified. In such circumstances, in order to receive the compensation relating to the exchange, the Bitworker will be obliged to proceed with the return.

Outside of such cases, the return is to be considered exclusively voluntary, unless otherwise agreed between the parties, possibly supported by an economic incentive offered by the Buyer. Bitpost in any case remains extraneous to such dynamics and neither suggests nor imposes any decision on the parties.

In the event that the return is not possible for reasons related to the relevant e-commerce platform, or due to the unavailability of the Bitworker in the absence of errors attributable to them, the Buyer expressly accepts that nothing shall be owed to them.

3.2) Return methods

a) Bitpost Anti-scam Return In specific dynamics, Bitpost makes available an Anti-Scam return service, aimed at preventing fraudulent conduct between the parties.

Before proceeding, the platform will apply an additional fee equal to 2.5% of the value of the item, necessary for the verification activities.

This method provides for:

  • Objective checks by Bitpost on the documentation provided;

  • Obligation to return exclusively through home pickup;

  • Use of couriers with a trackable shipping label;

  • Tracking monitoring by Bitpost until the item is returned to the e-commerce platform.

b) Free Return Alternatively, the parties may proceed with a return in free mode, without the intervention of the platform.

This method provides for:

  • No checks by Bitpost;

  • No penalty;

  • No additional fee for the return service.

The return will therefore take place in total autonomy between Buyer and Bitworker, who fully accept the risks associated with the procedure.

3.1 General return conditions for the AMAZON platform Purchase requests for items owned by Amazon follow special return conditions.

Purchase requests may be exercised through the GIFT OPTION.

This option allows the person who requests the item through the "gift option", namely the Buyer, to be entirely autonomous in the return request to AMAZON, without the need to further consult the Bitworker.

The user will be able to contact Amazon support directly and report the receipt of a "gift" from another user, providing the order number for the purposes of managing the return.

Amazon support, upon completion of the appropriate checks, will confirm receipt of the item as a "gift". Furthermore, having been provided with the order number, it will proceed to follow its own autonomous return policies with reimbursement by equivalent value through Amazon gift cards or through other initiatives it deems appropriate, paying the equivalent amount directly to the Buyer's account (these refund policies are taken from the Amazon.com website and are mentioned by way of example only and not exhaustively).

IMPORTANT DISCLAIMER: Bitpost is in no way responsible for decisions

and activities undertaken by Amazon regarding the return/refund or replacement of purchased items.

The Bitpost staff only provides the data relating to the exchange flow between the parties in order to enable the exchange in the form described above and consequently to provide the user with accessibility to request the return autonomously.

As a consequence of the completed exchange, every decision and/or activity relating to returns is entirely the responsibility of the Amazon staff, who will make their own decisions on the conformity of the return and on the nature of the refund; for these reasons nothing shall be attributable to Bitpost in the event that the return/refund/item replacement request is declined by the e-commerce platform.

3.2 Eligible Items To be eligible for a return:

The item must be unused, unwashed and in the same condition in which it was received.

The item must be in its original packaging with all tags and seals intact.

3.3 Ineligible Items Some items cannot be returned, such as (by way of example only and not exhaustively):

Gift cards Downloadable digital products Personal hygiene items Customized products

  1. Return Process

4.1 Initiation of the Return To initiate a return, in the "order history" section the user may query on the platform the line corresponding to the purchase made, always and exclusively if it falls within the timeframe provided by law and in the event that the counterparty accepts the request submitted.

Should the counterparty intend to accept the request, it will provide the Buyer with the label in the exact format that allows the latter to affix it to the package in order to carry out the return.

4.2 Shipping Costs The shipping costs for returning the item are borne by the user who requests the return. Shipping costs are non-refundable. If the Bitworker receives a refund, the return shipping cost will be charged to the Buyer through a deposit of additional funds including the Bitpost fee, which will then be paid to the Bitworker to cover the costs of the return procedure.

4.3 Transport Liability Bitpost is in no way liable for items lost during return shipping.

  1. Amazon Refund

5.1 Refund Process. (Without Gift Option) During the return request, the Buyer may exclusively receive the refund without any replacement and receive back the bitcoins paid once the return request is accepted by the Bitworker, who operates on a voluntary basis and at the unquestionable discretion of the Bitpost platform, except for errors by the Bitworker that will make the return mandatory.

5.2) Refund Process (with Gift Option)

Where the purchase has been made through a platform that allows it, the Buyer may choose between the following options, exclusively for Amazon items purchased with the Gift Option:

  • Replacement of the item, in the event that the e-commerce platform allows its application according to its own terms and conditions;

  • Monetary refund, in accordance with the methods provided by the e-commerce platform.

In such circumstances, the Buyer may interact independently with the e-commerce for the management of the return, which will be carried out in compliance with the return and refund policies provided by the platform itself.

Bitpost remains extraneous to the decisions and operating methods adopted by the e-commerce regarding the replacement or refund of the item.

5.3) Refunds on other e-commerce platforms

The Buyer may request the return by choosing between:

  • refund of the Bitcoins paid, or

  • replacement of the item, where the e-commerce platform used does not provide, according to its own terms and conditions, a monetary refund.

MONETARY REFUND

Where the refund is approved by the platform on which the purchase was made, the following dynamic applies:

  • The Bitworker will receive the refunded funds relating to the purchase made on behalf of the Buyer on their own payment method used on the e-commerce;

  • Upon the prior choice of the Buyer, accepted by the Bitworker, the latter will return to the Buyer the equivalent in Bitcoin;

  • The Buyer will grant the Bitworker a monetary donation for the activity carried out and for having enabled the return of the item to the e-commerce.

The Bitworker will therefore receive:

  • the amount refunded in fiat currency by the e-commerce;

  • the monetary incentive agreed with the Buyer.

Once the refund has actually been disbursed, the Bitcoins will be returned to the Buyer net of the donation granted to the Bitworker.

REPLACEMENT OF THE ITEM

Where the e-commerce platform does not allow the monetary refund but exclusively accepts the replacement of the item:

  • The Bitworker, following the return procedure, will request the replacement of the item from the e-commerce;

  • The Buyer will receive the new item as a replacement;

  • The funds deposited in the multisignature wallet will be unlocked in favor of the Bitworker upon completion of the exchange.

5.4) Mandatory nature of the return and choice of method

The Bitworker is obliged to proceed with the return in the following cases:

  • When an objective error attributable to the Bitworker is ascertained;

  • For purchases made on e-commerce platforms other than Amazon, in the presence of an error;

  • For purchases on Amazon in the absence of the Gift Option, since the Buyer has no possibility of managing the return independently.

For purchases made on Amazon with the Gift Option, the Buyer may manage the return independently without the need for the Bitworker's intervention.

In all cases where there is no error on the part of the Bitworker, the return is to be considered exclusively voluntary.

The choice of the return management method, between:

  • peer-to-peer procedure (without checks)

  • Bitpost Anti-Scam procedure (with checks)

always remains at the discretion of the Buyer, who accepts its costs, operating methods and consequences.

5.1.3 Refund refused by the platform If the platform on which the return was requested refuses the refund, nothing may be attributed to the Bitworker or to Bitpost.

In this case:

• The platform, according to its own return policies, will return the item to the delivery address provided in its regulations.

• The exchange will be considered concluded with a positive outcome, since the initial purchase is in any case delivered.

• The Bitworker must provide the emails received from the platform, which attest to the refusal of the return and the return of the item as described above.

5.2 Refund Timeframes The refund timeframes are parameterized and calculated based on the emails received by the Bitworker and sent to them by the e-commerce; it will be the Bitworker's responsibility to inform of the progress status of the refund.

  1. Replacements Replacements are subject to the same policies and dynamics as the returns described above, with further explicit reference to point 4.2 of this document (shipping costs where provided for by the e-commerce platform).

  2. Data transmission error for Purchases Where the user provides an incorrect characteristic relating to the ordered item, the user may request a return by following the instructions in the Returns section of the "terms and conditions" document.

Anything not expressly indicated in this "terms and conditions" form expressly refers to what is set out in the service usage regulations and, ultimately, to the provisions of Italian law.

  1. Funds left unmoved beyond the withdrawal period Users who use the Bitpost service expressly acknowledge that funds left unmoved beyond the 30-day time limit will be redistributed in the following manner: the parties will be contacted to technically provide their acceptance of the movement of funds from the multisig wallet; 20% of the funds will be granted to the party who cooperated in the withdrawal; 80% will be sent to Bitpost's coffers 6) SECURITY CHECKS AND DOCUMENTARY AUTHENTICATION (.EML VERIFICATION) Bitpost operates as a platform that facilitates peer-to-peer exchanges between users, integrating specific security measures aimed at protecting the parties involved in the exchange.

In the presence of reports, anomalies, inconsistent information or issues relating to the order, delivery or return, Bitpost reserves the right to initiate documentary verification procedures in order to ascertain the accuracy of the information provided by the users involved.

As part of such checks, the platform may request from the Bitworker documentation suitable to certify the purchase made on the e-commerce platform used for the exchange.

For purchases made through Amazon and, progressively, through other supported e-commerce platforms, Bitpost may request the sending of the original email received from the seller, in order to verify information such as:

  • existence and correct placement of the order;

  • confirmation of delivery;

  • characteristics of the purchased item;

  • quantities purchased;

  • any information relating to returns or refunds.

The requested documentation must be provided exclusively in the original .eml format, so as to allow the platform to verify its authenticity, integrity and the consistency of the information contained therein.

The Bitworker must access the dedicated verification section on the platform and upload the requested file within the timeframes indicated by the timer displayed during the procedure.

Failure to transmit the requested documentation within the prescribed terms may result in the automatic closure of the exchange in favour of the Buyer, with the consequent issuance of the refund. In such cases Bitpost may consider the dispute procedure definitively concluded, subject to different assessments made by the platform.

Once the documentation has been received, Bitpost will proceed with the necessary technical and documentary checks. Should the information prove consistent and authentic, the exchange may proceed as normal. In the event of false, inconsistent, altered or unverifiable information, the platform may adopt proportionate measures, including the closure of the exchange, the limitation of account functionalities and the application of reputational penalties.

  1. Additional costs for the management of returns, verifications and penalties Bitpost reserves the right to apply additional costs for the coordinated management of return procedures, including monitoring activities, tracking verification, documentary authentication and management of disputes between the parties.

In particular, the platform may request an additional commission of up to 2.5% of the value of the exchange or, in cases of errors relating to the quantities purchased, withhold 2.5% of the economic difference resulting from the error found, charged to the party deemed responsible for errors, inconsistent information, breaches of operating procedures or fraudulent conduct relating to the exchange, the return or the documentation provided.

Bitpost also reserves the right to apply reputational penalties, operational limitations of the account or, in the most serious cases, the total or partial loss of the funds deposited in the exchange, charged to the party responsible for the breach.

The decisions adopted by the platform are made on the basis of documentary checks, available information, tracking, communications received and the security procedures integrated within the service. 8) Referral Programme and User Network Bitpost may make available to users a personal referral link that can be shared with third parties in order to invite new users to register and use the platform.

Users who complete registration through a referral link will become part of the network of the user who made the invitation. The referral system is intended exclusively for the promotion and growth of the Bitpost community and may not be used for spam activities, deceptive practices, the creation of fictitious accounts, self-referrals or any other activity contrary to the law, to these Terms and Conditions or to the principles of fairness and good faith.

The user who made the invitation may receive Bitpost Points as a form of reward for the activities carried out by the users belonging to their network. In particular, Bitpost may assign Bitpost Points on the occasion of purchases, exchanges or other operations deemed valid and completed by users registered through the inviting user's referral link.

Bitpost Points represent exclusively an internal promotional tool of the platform and do not constitute legal tender, electronic money, cryptocurrency, financial instrument or any other form of convertible monetary value.

The accumulated Bitpost Points may be used, in accordance with the terms and conditions established by Bitpost, to obtain discounts, promotional advantages or preferential conditions in the purchase of products and services available within the platform or at any participating commercial partners. The value of the applicable discounts may vary depending on the number of Bitpost Points accumulated by the user.

Bitpost reserves the right to modify, suspend, limit or revoke at any time the Referral Program, the criteria for awarding Bitpost Points, the manner in which they are used and the related reward percentages, without this giving rise to any right to compensation or indemnity in favor of users.

Any attempt to manipulate the Referral Program, create multiple accounts, simulate activity, carry out self-referrals or obtain advantages fraudulently will result in the cancellation of the rewards accrued and may lead to the suspension or permanent closure of the user's account.

Below is the table of commissions, prizes and rewards awarded based on the number of invited users and the activities carried out by one's own network. This version is suitable for being inserted directly into the official Bitpost regulations.

  1. Bitpost Points Bitpost Points are reward points awarded to users in relation to the activity generated by their own referral network within the Bitpost ecosystem. Bitpost Points are not awarded for purchases, exchanges or operations carried out directly by the user on their own account. They are attributed exclusively as a result of the eligible activities carried out by users registered through the user's personal referral link and belonging to their network. In particular, Bitpost may award Bitpost Points when users belonging to the referral network complete exchanges, purchases or other activities considered valid for the purposes of the Referral Program. Bitpost Points are intended exclusively for use within the Bitpost platform and do not constitute legal tender, electronic money, cryptocurrency, financial instrument, security or any other form of monetary value. Bitpost Points may be used to obtain discounts, promotional advantages, special offers or price reductions on products and services made available through the Bitpost platform or through any participating commercial partners. The value of the discounts or benefits obtainable through the use of Bitpost Points is determined by Bitpost and may vary depending on the product, service, promotion or specific initiative available at the time of use. Bitpost Points have no monetary value, cannot be converted into cash, transferred as a means of payment or redeemed outside the Bitpost ecosystem, unless otherwise expressly authorized by Bitpost. Bitpost reserves the right, at its sole discretion, to modify, suspend, limit or discontinue the Bitpost Points program, including the awarding criteria, the manner of use, the eligibility requirements and the applicable benefits, at any time. Below is the table of Bitpost Points awarded based on the activity generated by the users belonging to the user's referral network and the related usage thresholds and available benefits. This version makes it very clear that the points are a network reward and not a traditional cashback or loyalty system. 10. Experience, Reputation and Trade Points

10.1 Experience (Experience Points)

Experience represents the user's level of participation and engagement within the Bitpost platform.

Experience is accumulated through:

  • the completion of exchanges on the platform;

  • the role held during the exchange (for example Buyer or Bitworker);

  • the use of the various flows and tools made available by Bitpost;

  • collaborative and constructive behaviors toward the community and other users.

Experience is intended to enhance the user's activity and their overall contribution to the Bitpost ecosystem.

Bitpost reserves the right to modify at any time the criteria for awarding, accumulating and calculating Experience.

10.2 Reputation (Reputation Score) Reputation represents an indicator of the user's reliability within the platform.

Reputation is calculated automatically on the basis of several factors, including:

  • positive or negative outcome of the exchanges carried out;

  • compliance with the platform's rules;

  • behavior held toward other users;

  • any disputes, reports or established violations.

The reputation score is expressed as a percentage (%) and may increase by 0.1% for each successfully completed exchange and decrease by up to 10% for attempted scams established and verified based on the activities carried out by the user.

Reductions in Reputation are determined by the type and severity of the actions that generated the penalty.

In specific areas of the platform characterized by collaborative, voluntary or community-benefit activities, Reputation may benefit from multipliers or bonuses defined by Bitpost.

Bitpost reserves the exclusive right to establish and modify the criteria for calculating Reputation.

10.3 Trade Points

Trade Points represent an indicator of the user's responsiveness and operational efficiency during exchanges.

Trade Points are awarded and calculated primarily on the basis of:

  • the speed of response to received requests;

  • the speed of execution of the requested operations;

  • the timeliness in the interactions between the parties involved in the exchange.

In certain circumstances, Trade Points may be subject to bonuses or multipliers arising from collaborative, voluntary activities or activities that are particularly useful for the proper functioning of the platform.

Trade Points do not constitute a vested right and may be modified, recalculated, suspended or revoked by Bitpost where this becomes necessary to ensure the integrity of the system.

Final note

The Experience, Reputation and Trade Points systems have exclusively informational, statistical and incentive purposes within the Bitpost ecosystem. Such scores do not constitute financial instruments, credits, securities of value or guarantees of any kind and do not confer any economic right against Bitpost, except where expressly provided for by the platform.

SECTION 14: FINAL PROVISIONS

  1. Applicable Law These terms are governed by Italian law and the competent court for any dispute is that of Milan.

  2. The User who accepts this document in all its sections expressly declares to accept all the clauses of this document, including those for which specific acceptance is required, such as, by way of example only, the one relating to the applicable law, to the competent Court for disputes that arise, or all the clauses relating to unilateral modifications of the terms.

  3. By using Bitpost, the user confirms that they have read, understood and accepted these Terms and Conditions in all their parts.
